Acceptable Uses Policy

General
As a Hosting Provider, IT Software offers its customers the means to acquire and disseminate a wealth of public, private, commercial and non-commercial information. IT Software also wants its customers to be fully informed of their rights and obligations ­ and those of IT Software ­ in connection with their use of the Internet. The services agreement is intended as a plain English guide to those rights and obligations.
When customers disseminate information through the Internet, they also must keep in mind that IT Software does not review, edit, censor or take responsibility for any information its customers may create.

The Acceptable Uses Policy defines the actions which Web Hosting Provider considers to be abusive, and thus, strictly prohibited. The examples provided in this list are non-exclusive, and are provided only for guidance to Web Hosting account holders. If you are unsure if a certain action is legal or permitted on IT Software servers, feel free to email [email protected] with your questions and we will assist you.

Please be aware that IT Software reserves the right to cancel any account we find in excessive violation of any of the below activities.

Email Spamming:
Unsolicited, commercial mass e-mailing (email “spamming”) is a strongly disfavored practice among Internet users and service providers.

It is particularly harmful not only because of its negative impact on consumer attitudes toward IT Software, but also because it can overload IT Software’s equipment and disrupt service to our customers.

Our Accepted Uses Policy forbids the transmission of certain types of e-mail. Bulk e-mail can be acceptable under the circumstances outlined below:

1) You should have a prior relationship with the person receiving the e-mail, and they should be aware that they will be receiving e-mail from your domain.
2) If you have a subscription list, there should be a confirmation e-mail sent to the address before that address is added.
3) There should always be a way to quickly and easily unsubscribe from the list included in each e-mail, and all unsubscription requests should be quickly honored.
4) A valid “From:” and “Reply to” address must be included with each message.

The following items would violate our policy:

1) Any kind of forged header information.
2) “Targeted” e-mail lists.
3) Using a script on your site to send bulk or unsolicited e-mail.
4) Using an autoresponder at your site to send bulk or unsolicited e-mail.

Distribution and/or Transmission of Obscene or Indecent Speech or Materials:
Violation of indecency and obscenity laws can result in criminal penalties

Copyright Violation:
Violation of copyrights held by individual and business or other entities can result in civil and criminal liability, and can involve the Web Hosting Provider in litigation and possible loss of reputation.

You will be responsible for any licensing on a local, state, governmental and/or international level. Please also be aware that any and all information posted on the Internet can be copied, challenged by anyone for any reason.

Unauthorized/Illegal Access to Other Computers or Networks:
The illegal or unauthorized accessing (known as “hacking” or “cracking”) of computers or networks can result in civil and criminal penalties under both federal laws and the laws of most states.

Export Control Violations:
The law limits the ability of persons to export encryption software, over the Internet or otherwise, to points outside the United States

Other Activities:
Whether lawful or unlawful, that IT Software determines to be harmful to its customers, operations or reputation, including any activities that restrict or inhibit any other user from using and enjoying the service or the Internet.
